Family Law in Scotland
In Scotland, the courts will not become involved in the decisions
families make following a separation, unless they are asked. Mediation can help you make decisions about your children
and your finances, without involving the courts.
If this is not possible, the law provides a framework to help the
courts make decisions on your behalf, to ensure the welfare of your children and a fair way to divide any assets.
In order to help you understand Family Law in Scotland,
we have prepared a short paper, which answers the questions outlined below.
What are the parental rights and responsibilities?
Who has these rights and responsibilities?
What does this mean in practice?
What about shared parenting?
What about children themselves?
What about the courts?
